UK data protection after the DUAA

The Data (Use and Access) Act 2025 has pulled the UK regime away from the EU one. The changes that matter if you are processing personal data on a UK server: a seventh lawful basis for processing has been added to Article 6(1) of the UK GDPR, called "recognised legitimate interests"; Article 22 on automated decision-making has been rewritten entirely and replaced with four new Articles 22A to 22D; subject access requests now work on a "reasonable and proportionate search" standard with a stop-the-clock mechanism for clarifying requests; and first-party cookies used purely for statistics and site improvement no longer require consent, though consent for everything else still does.

Two consequences worth planning around. First, penalties for cookie consent breaches are now aligned with UK GDPR levels — the previous cap was £500,000, and that ceiling is gone. Second, the ICO is being restructured into the Information Commission. On the transfer question, the EU renewed the UK's adequacy decision through December 2031, so EU-to-UK data movement remains straightforward for now. If you have been treating UK GDPR and EU GDPR as one policy, that shortcut no longer holds and your documentation needs splitting.
