US hosting and cross-border data rules

If you are outside the US and putting personal data on a US server, the mechanism you rely on is the EU–US Data Privacy Framework. Its status as of mid-2026: the framework is valid law. The European Commission's 2023 adequacy decision stands, and the EU General Court dismissed the first direct challenge to it on 3 September 2025 (Latombe v Commission, Case T-553/23), finding the US Data Protection Review Court sufficiently independent and US limits on bulk collection adequate.

The caveat worth knowing: that judgment was appealed to the Court of Justice of the EU on 31 October 2025 (Case C-703/25 P) and the appeal is still pending, with no hearing date announced. The CJEU — not the General Court — is the body that struck down both Safe Harbor and Privacy Shield. So US hosting is lawful for EU data today, but if your compliance position cannot survive a change, keep Standard Contractual Clauses in place as a fallback or host inside the EU instead. For UK data, the UK's own extension of the framework applies.
